Levl Terms of Use

These Terms of Use ("Terms") govern your use of the Levl mobile application and related services ("Levl," the "App," or the "Service"), operated by Cultura Cortes LLC ("Cultura Cortes," "we," "us," or "our").

By accessing or using Levl, you agree to these Terms. If you do not agree, do not use the Service.

1. Purpose of Levl

Levl is an educational and general-wellness application designed to help users better understand behavioral patterns, develop self-awareness, manage urges, build healthier routines, and support personal growth.

Levl is not a medical, psychiatric, psychological, or other healthcare service, and the information and tools provided through Levl are not intended to diagnose, treat, cure, or prevent any medical or mental-health condition.

2. Health & Wellness Disclaimer

The educational materials, assessments, guided exercises, breathing practices, grounding techniques, journaling prompts, abstinence-related content, and other tools within Levl are provided for general educational and wellness purposes only.

Individual experiences when changing longstanding behaviors can vary. Certain temporary experiences - such as cravings, changes in mood, motivation, arousal, or emotional discomfort - may occur during periods of behavioral change and are discussed within Levl's educational materials. However, Levl cannot assess your individual health or determine whether a particular symptom is medically significant or requires professional care.

If you experience severe or persistent distress, symptoms that substantially interfere with daily functioning, concerns about your physical or mental health, or concerns for your safety or well-being, seek guidance from an appropriate qualified healthcare professional.

If you believe you are experiencing a medical or mental-health emergency, contact emergency services or an appropriate crisis resource in your area.

Using Levl does not create a doctor-patient, therapist-client, or other healthcare professional relationship between you and Cultura Cortes LLC.

3. Educational Assessments

Any assessment, score, risk level, progress indicator, recovery meter, or similar feature provided by Levl is intended solely as an educational or self-reflection tool.

These features are not clinical assessments, diagnoses, medical evaluations, or predictions of health outcomes and should not be interpreted as such.

4. Individual Results

Levl is designed to support behavior change by providing educational material, practical tools, guided exercises, and systems for self-awareness and accountability.

The value you receive from Levl will depend in part on how consistently and thoughtfully you engage with its tools and curriculum. Simply downloading or accessing Levl does not guarantee a particular outcome.

Levl does not guarantee that every user will stop a particular behavior, maintain abstinence for a specific period of time, or achieve any specific personal, mental-health, or recovery outcome.

5. Eligibility

You must be at least 14 years old to use Levl.

By using Levl, you represent that you meet this minimum age requirement and are legally permitted to use the Service under the laws applicable to you.

If you are under the age at which you may independently agree to these Terms in your jurisdiction, your use of Levl may require the involvement or permission of a parent or legal guardian as required by applicable law.

Levl does not require you to provide your name, email address, date of birth, or other identifying account information to use the core Service at launch. Certain features or services introduced in the future may have additional eligibility, consent, or privacy requirements.

Access to Levl through the Apple App Store or another marketplace may also be subject to the age ratings, parental controls, purchase restrictions, and account settings maintained by that platform.

6. Subscriptions and Purchases

Certain Levl features may require a paid subscription or other in-app purchase.

Purchases and subscriptions made through the Apple App Store are processed through Apple and may be supported by third-party subscription-management services. Cultura Cortes LLC does not directly process or store your complete payment-card information.

If you purchase an auto-renewable subscription:

• your subscription will renew automatically unless canceled in accordance with the rules of the applicable app marketplace;
• pricing and billing frequency will be displayed before purchase;
• subscription management and cancellation are handled through your applicable App Store account; and
• access to paid features may end when your subscription expires or is canceled.

Any free trial, promotional price, founding price, introductory offer, or similar promotion will be subject to the terms displayed when the offer is made.

7. License to Use Levl

Subject to these Terms, Cultura Cortes LLC grants you a limited, personal, non-exclusive, non-transferable, revocable license to use Levl for your own lawful personal use.

You may not copy, distribute, sell, sublicense, reverse-engineer, exploit, reproduce, or commercially use Levl or its protected content except where expressly permitted by law or by Cultura Cortes LLC in writing.

8. Intellectual Property

Levl contains original content created by or for Cultura Cortes LLC, including written lessons, audio recordings, scripts, graphics, branding, interface elements, educational materials, and the original selection, organization, and presentation of content within the Service.

Those original materials are owned by or licensed to Cultura Cortes LLC and are protected by applicable intellectual-property laws.

Levl also discusses concepts, practices, techniques, and ideas that may be widely known, publicly available, drawn from established fields of study, or associated with third-party authors, educators, researchers, or traditions. Cultura Cortes LLC does not claim ownership over such underlying ideas, methods, facts, or generally known practices.

Your use of Levl does not grant you ownership of Levl's original content or permission to reproduce, distribute, sell, publish, or commercially exploit that content except as permitted by law or with our written authorization.

9. Acceptable Use

You agree not to use Levl to:

• violate any applicable law;
• interfere with or attempt to compromise the security or operation of the Service;
• access the Service through unauthorized automated means;
• copy, scrape, reproduce, or redistribute protected Levl content without permission;
• impersonate another person or misrepresent your affiliation with another person or organization; or
• use the Service in a manner that could damage Levl, Cultura Cortes LLC, or other users.

10. Your Information and Privacy

Your use of Levl is also governed by our Privacy Policy, which explains how information associated with the Service is collected, used, stored, and handled.

The Privacy Policy is incorporated into these Terms by reference.

11. Third-Party Services

Levl may rely on or link to third-party services, platforms, software, communities, content-delivery or streaming providers, and other infrastructure, including app marketplaces and payment or subscription providers.

Your use of those services may also be subject to the eligibility requirements, terms, privacy policies, community rules, and other policies of those third parties.

Cultura Cortes LLC is not responsible for the independent acts, policies, availability, or performance of third-party services outside our reasonable control.

12. Availability and Changes to the Service

We may modify, improve, update, suspend, or discontinue parts of Levl from time to time.

We do not guarantee that every feature will always remain available or operate without interruption, error, delay, or technical failure.

13. Disclaimer of Warranties

To the fullest extent permitted by applicable law, Levl is provided on an "as is" and "as available" basis.

Cultura Cortes LLC makes no warranty that the Service will be uninterrupted, error-free, free from technical issues, or suitable for every individual's circumstances.

Nothing in these Terms excludes warranties or rights that cannot legally be excluded under applicable law.

14. Limitation of Liability

To the fullest extent permitted by applicable law, Cultura Cortes LLC and its owners, officers, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to your use of - or inability to use - Levl.

Nothing in these Terms limits liability where such limitation is prohibited by applicable law.

15. Termination

You may stop using Levl at any time.

We may restrict or terminate access to the Service if you materially violate these Terms, misuse the Service, compromise its security, or where otherwise reasonably necessary to protect Levl, its users, or Cultura Cortes LLC.

Termination does not automatically entitle you to a refund except where required by applicable law or the applicable App Store's policies.

16. Changes to These Terms

We may update these Terms from time to time as Levl changes or as legal or operational requirements evolve.

When material changes are made, we may provide notice through the App or another reasonable method.

The updated Terms will state their new effective date.

Where required, we may ask you to accept updated Terms before continuing to use Levl.

17. Governing Law

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles, except where applicable consumer-protection law requires otherwise.
